These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "Creator") and CGS 360 Technologies ("CGS 360", "we", "us", or "our"), governing your access to and use of IGENT (available at https://igent.cgs360.in) and all related APIs, dashboards, and automated services.

By creating an account, connecting an Instagram Professional account, or utilizing any feature of IGENT, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our companion Privacy Policy. If you do not agree to these Terms, you must immediately discontinue using our services.

IGENT interacts with Instagram solely through official, approved Meta APIs. As an express condition of using our platform, you covenant and agree to comply at all times with:

• Meta Messenger API for Instagram Policies

In strict adherence to Meta's direct messaging standards, the following policies govern all outbound messaging from your connected Instagram accounts:

When using comment automation rules (such as replying to comments containing designated trigger keywords or sending private DM responses):

• Automated responses must provide direct value (e.g. sharing a product catalog, link, or answering a customer question) and must not be deceptive or misleading.
• Private comment replies are permitted only once per user comment and within 7 days of the comment, in accordance with Meta's comment private reply specifications.
• Automated moderation (hiding/filtering comments) must not be utilized to suppress lawful consumer complaints or mislead the public regarding product safety.

Your Warranties: You represent and warrant that you own or possess all necessary rights, licenses, releases, and permissions for any content you upload, schedule, or publish through IGENT. You agree not to upload or publish any content that infringes upon third-party copyrights, trademarks, privacy rights, or publicity rights.

Connecting an Instagram Professional account occurs strictly through official Meta OAuth 2.0 dialogs. We never ask for, access, or store your personal Instagram or Facebook password.

You agree not to engage in any of the following prohibited activities:

• Reverse engineering, decompiling, or attempting to extract the source code of IGENT or Meta APIs.
• Using unauthorized scrapers, spiders, or automated bots outside official Meta Graph API endpoints.
• Buying, selling, or facilitating the exchange of fake followers, artificial likes, or fraudulent engagement.
• Bypassing platform rate limits, security tokens, or tenant-isolation safeguards.
• Using our platform for phishing, distribution of malware, hate speech, harassment, or illegal gambling.

In strict compliance with Meta Developer Policy Section 4.a, CGS 360 does not sell, lease, license, trade, or broker Meta User Data, follower profiles, message transcripts, or audience analytics under any circumstances. Data retrieved through Meta APIs is processed solely to fulfill creator-configured automations.

IGENT automatically monitors and enforces Meta Graph API rate limits. Outbound messages and publishing jobs are throttled when approaching platform limits to safeguard your Instagram account against suspension.

You acknowledge that our service depends on the continuous availability and policies of Meta Platforms, Inc. CGS 360 shall not be liable for temporary service interruptions, API downtimes, or feature modifications implemented by Meta.

In compliance with Meta Developer Policy Section 3.d, every user retains the unconditional right to disconnect their Instagram account and demand permanent deletion of their data at any time:

• Self-Service Disconnection: Disconnecting an account via the Dashboard immediately purges all encrypted OAuth access tokens and clears active conversation sync.
• Automated Meta Deletion Callback: When removing IGENT in Facebook settings, Meta calls our compliant endpoint at https://igent.cgs360.in/api/meta/compliance/deletion to execute a cryptographic wipe.
• Status Lookup: Verify deletion completion using your confirmation code on our Data Deletion Status Page.

Subscription plans (Starter, Growth, Agency) are billed on a recurring monthly or annual basis via authorized payment gateways (Stripe & Razorpay). You may cancel your subscription at any time through Dashboard > Settings.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IGENT AND CGS 360 ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

In no event shall CGS 360 Technologies, its officers, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your access to or inability to use the platform.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
